These terms and conditions confirm the legal terms (Terms) on which we will sell the products (Products) listed on our website (our site) and in the Mackintosh catalogue (Mackintosh of Omega Plc)
where applicable hyperlinks to this information is set out within these Terms.
These Terms apply to any contract between us for the sale of Products (Contract). Please read them carefully
and make sure that you understand them before you place your order. You should also print a copy of these
Terms for your future reference.
How the Contract Is Formed Between Us
Our order process allows you to check and amend any errors before submitting your order to us.
Please take the time to read and check your order at each stage of the order process.
After you place an order, and subsequently pay a 50% deposit contribution, we will send you an e-mail to confirm
that we have received it (Order Acknowledgement). However, this does not mean that your order has yet been
accepted by us.
Unless you cancel your order in accordance with our Cancellations and Refunds policy (see below) or we have
contacted you to confirm that we are unable to accept your order, our acceptance of your order will occur
automatically 14 days prior to the scheduled delivery date of your goods.
We reserve the right to reject any order for any reason and no goods will be dispatched until payment is received
in full for all Products and any related delivery charges.
All orders are subject to stock availability. If we are unable to supply any of the Products that you have ordered
we will inform you as soon as possible. In the event that an out-of-stock product is part of an order and we cannot
contact you, we will send what products we have in stock, and the remedial items will follow at the earliest
How to Pay
Customers can confirm orders with deposit payments equating to 50% of the order value (including VAT). This
payment enables us to begin the order process and schedule an appropriate delivery slot for your goods. The
remaining balance will be due for payment no later than 7 days prior to you pre-agreed deliver date.
You can pay by Bank Transfer, cheque, debit or credit card. We accept the following cards: Visa and Mastercard
credit cards, Visa and Mastercard debit cards, and American Express.
Transaction fees apply to all card payments, these fees are 3.5% of the transaction value for credit cards and
Amex. (Reducing to 2.5% for debit cards)
Payment for Products (including any delivery charges) will be debited from your payment card at the time of
placing your order. This does not mean that your order has been accepted and, if for any reason, your order is
not accepted or we are unable to supply the Products you have ordered a full refund will be issued, including any
card transaction fees you may have incurred as a result.
Price of Products
All Mackintosh products have a recommended list price, a copy of which is available upon request. The prices we
quote to our customers for Mackintosh products may be less than, but will never exceed their recommended
retail price (‘List Price’). The price charged will be that quoted and any VAT amount chargeable to you will be
clearly defined within the terms of your quotation.
Our standard delivery service for delivery of Mackintosh kitchens, is included free of charge to any address within the UK mainland.
Appliances and Joinery items many be chargeable, subject to the volume and chosen brand of product, please
refer to your quotation for confirmation of delivery charges.
All quoted delivery dates and times are estimates and although we will try our best to meet them we will not be
responsible if we are unable to do so. We will let you know if we cannot deliver your products within 28 days of
when we receive your payment and will give you the option to either wait for the Products or cancel your order
and receive a full refund.
We strongly recommend that you do not book fitters or trades persons until your delivery date has been
confirmed by us, in writing. We cannot be held responsible for any third-party costs or charges which you incur
due to a late delivery. Times cannot be guaranteed, and we therefore recommend that you do not schedule
installation to begin on the same day as your delivery.
We are not able to process orders or deliver on UK Bank Holidays, Saturdays or Sundays.
All orders will be delivered to a single address. For security reason’s your first order using a credit/debit card for the first time by phone, will need to be delivered to the cardholder’s address. Subsequent orders can then be
made to an alternative address.
To minimise inconvenience we will, wherever possible, try to ensure that direct deliveries of appliances follow 72 hours later than your kitchen furniture. When you place an order containing a mix of products including ‘Supplier Delivered’ items, one single delivery will not be possible as ‘Supplier Delivered’ products are delivered direct from the supplier. (Appliances will always be delivered separately, as will sinks / taps in some cases)
All deliveries must be received and signed for by a person over the age of 18. If no-one is available to take the
delivery, we will leave details at the address to rearrange delivery. We may need to make an additional handling
charge for redelivery.
Risk of loss and damage in the Products will pass to you on the date when the Products are delivered or on the
date on which we make our first attempt to deliver them to you.
Refunds / Cancellations
You can cancel an order (excluding ‘made to measure’ joinery products, which are non-refundable) and receive a full refund by confirming your wish to cancel the order in writing (or email) no later than 14 days prior to delivery.
Refunds will be paid by cheque, or directly back onto the payment card used to place the order and will be
processed within 48 hours of your request being confirmed.
Faulty or Damaged Products
In the unlikely event that a delivered product is faulty or damaged, we will exchange it or provide you with a
refund, so long as we are notified of the product’s fault within 30 days of it being delivered to you.
We will collect it at no expense to you and either provide a replacement or process a refund.
Mackintosh – Deposit Guarantee Scheme
Mackintosh Kitchens’ Deposit Guarantee Scheme offers you peace of mind and certainty when you purchase a
Mackintosh Kitchen from Lime Designs (Lime Designs are an ‘approved Mackintosh retailer’)
Should we (Lime Designs) cease to trade before we have delivered your kitchen they (Mackintosh) guarantee to
supply your Mackintosh Kitchen furniture at the current manufacturer’s recommended retail price, less the deposit paid, provided that the amount paid to the retailer does not exceed 50% of the manufacturer’s recommended retail price.
This guarantee is in addition to your legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.
Kitchen Furniture (by Mackintosh / Omega PLC)
All Mackintosh kitchen furniture comes with a 10-year guarantee to give you peace of mind when agreeing to
purchase. For a period of 10-years from the date of purchase, your Mackintosh Kitchen cabinets and facias
manufactured by Omega PLC are free from defects in material and workmanship.
Kitchen Furniture (by ‘any other’)
Kitchen furniture specified from manufacturers other than Mackintosh, may have alternative guarantee terms.
Any quotations for products of this nature will be provided with a clearly defined set of terms and conditions to
reflect those alternative guarantee terms.
Our preferred partner supplier for appliances is the Electrolux group, consisting of ‘AEG’, ‘Zanussi’ and
‘Electrolux’. The manufacturers guarantee associated with these brands can be found on their website, and/or
product literature provided by Lime Designs.
Extended warrantees for appliances are available upon request, please speak directly with the manufacturer or
call Lime Designs on 01306 884666 for further advice.
If any product which we supply is proven to be damaged or defective we will either repair or replace the Product
or offer a refund less a fair amount on account of your use of the Product.
Where we are unable to perform our obligations under the Contract due to matters outside of our control or if we supply a product that is damaged or defective we will not in any circumstances accept liability for any claim to recover loss of profits or any special or indirect loss, damage or expense. Nothing in these conditions excludes or limits in any way our liability for:
a) death or personal injury caused by our negligence;
b) fraud or fraudulent misrepresentation; or
c) any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
As a consumer, you may have additional legal rights in relation to Products that are faulty or not as described and nothing in these Terms affects these rights. Further advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
Other Important Terms
Our website and its contents and any Contract formed as a result of its use shall be governed by and construed
in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.
If you are not satisfied with your purchase please contact Lime Designs by telephone 01306 884666. We will try to resolve any issues that you have as quickly as possible. If you remain unhappy with our final response, you may be entitled to refer your complaint to The Furniture Ombudsman
